The owner of the
AIFOS property promotion has been cleared at a hearing in Malaga of
misappropriating money from a woman who paid to buy two houses in Casares that were
never built. It was held that it was proven that the money handed over could
have been used for alternative constructions, although these were never carried
out. Lawyers for the woman claimed that she handed over 157,000 Euro in 2004
for the sale. Although a licence was granted, work on the project was
never commenced and in 2008 the woman claimed the contract had been terminated
and asked for a refund of the money. However the judgment said that the injured
party had already recognised that over 121,000 Euro had been paid in advance as
part of the company assets.
